Cuttack: The Court of the District Consumer Disputes Redressal Commission, Cuttack has ordered the Branch Manager of the city branch of a shopping mall chain and its Managing Director to pay a compensation of Rs 10,000 to a customer (the complainant) for causing mental agony and harassment.
In addition to that, the Commission has directed the Branch Manager and Managing Director of the shopping mall chain to pay Rs 15,000 to the complainant towards his litigation expenses.
The Commission has ordered for carrying out of the aforementioned order within a period of 30 days from the date of receipt of the copy of the order.
The complainant in his petition to Commission had named the Branch Manager of the shopping mall chain’s city office and its Managing Director as opposite parties. The shopping mall chain has its head office in Kolkata.
One Padmalochan Rout of Haripur Muliasahi under Purighat police station of the city (the complainant) had purchased a T-shirt from the shopping mall chain’s city branch for a price of Rs 249 on 28 December 2020 and in addition to that was charged Rs 6 towards a carry bag by the shopping mall.
The Commission came to a definite conclusion that the authorities of the shopping mall chain concerned by not mentioning the price of the carry bag to be Rs 6 conspicuously at any place within their shop and also upon the carry bags as sold by them and by not intimating about the price to the complainant before selling it to him, they were adopting unfair trade practice and thus they were deficient in their service as alleged by the complainant.
