Bhubaneswar: The Designated Court under OPID Act, Cuttack has made an ad-interim order and directed Cuttack ADM to sell the property of Sarala Realcon Pvt. Ltd., its Managing Director Gayadhar Jena and other Directors through auction and compensate 238 cutomers of the company who were duped of Rs 17 crore, the Economic Offences Wing (EOW) of Odisha Crime Branch stated.
The property include immovable landed property of area more than 95 acres cost around Rs 13.81 crore, frozen bank balance of Rs 13.10 lakh, seized cash of Rs 3.25 lakh and four vehicles – Scorpio Hawk ABS, Pajero SFX, BMW-X5-3, OD SAV and Toyota Fortuner.
In the year 2015, EOW, Bhubaneswar had registered a case against on the allegation of collecting crores of rupees from public unauthorised/illegally with assurance to provide them with home stayed land/plot in different prime locations.
“The accused persons and the company M/s Sarala Realcon Pvt. Ltd. instead of honouring the commitment made by them to the depositors/investors defaulted in providing with the land and thus, failed to render such service and also failed to refund the deposited amount,” the EOW stated.
“It was ascertained during investigation that the accused company and its Managing Director and Directors fabricated false documents and thereby executed registered sale deeds so as to act in a calculated manner with an intention to cheat/defraud the depositors/intending buyers.”
After completion of investigation, charge-sheet in this case has been filed under Sections 467/468/471/420/120-B of the IPC and Section 6 of OPID Act, 2011 against M/s Sarala Realcon Pvt. Ltd. and its Managing Director Gayadhar Jena and five others. The case is now subjudice in the designated court under OPID Act, Cuttack.
During investigation of the case, the movable and immovable properties amassed by Jena and other Directors out of the public deposits in their names as well as in the name of the company M/s Sarala Realcon Pvt. Ltd. were traced and an ad-interim proposal for attachment of those property was submitted by EOW under the provision of Section 3 of OPID Act.
